Business motor vehicles that are DOT licensed must comply with Federal regulations issued by the FMCSA under the FMCSR with its accompanying federal regulations and have mandatory requirements on insurance coverage.
DOT Licensed Vehicles
Business motor vehicles that are DOT licensed must comply with Federal regulations issued by the FMCSA under the FMCSR with its accompanying federal regulations and have mandatory requirements on insurance coverage.
- Bodily injury and property damage – The minimum coverage levels under 49 CFR Part 387.9 include requirements for a motor vehicle with a gross vehicle weight of 10,000 pounds or more will require minimum liability coverage of $750,000 for property carrying nonhazardous vehicles and $5,000,000 for hazardous substance transportation vehicles.
- Motor Carriers of Passengers – Under 49 CFR Part 387.33 any For-hire motor carriers of passengers operating in interstate or foreign commerce with a seating capacity of 16 passengers or more, including the driver, must carry minimum limits of $5,000,000. Any vehicle with a seating capacity of 15 passengers or less, including the driver, must carry a minimum coverage of $1,500,000.
- MCS-90 endorsement – Motor carriers must obtain a motor carrier policy of insurance for public liability (MCS-90) endorsement for their insurance policies. This endorsement requires the insurance carrier to meet the minimum requirements of liability insurance coverage if the policy is canceled or lapses.
- State requirements – separate state insurance requirements may also apply and must be met. The DOT regulations are minimum standards, so state laws supersede the federal laws if there are higher limits required by the state. Motor carriers can carry higher limits of coverage on a discretionary basis.

Non-DOT Licensed Fleet Delivery Vehicles
There are no universal minimum liability insurance coverage amounts for business fleet vehicles that are not DOT licensed under federal regulations.
Most experts who understand management of fleet delivery vehicles should carry the following:
- Minimum liability coverage per fleet vehicle in the amount of $1 million or more for business fleets.
- Fleet delivery businesses should always consult a professional insurance agent in their state to conduct an appropriate risk management assessment and determine what the adequate coverage would be for the type of business and number of miles driven.
- Most insurance experts will provide the fleet delivery businesses an option of adding uninsured and underinsured motorist coverage to protect their drivers and any passengers.
- Larger businesses with a more substantial fleet will typically add insurance coverage in the form of an umbrella policy with limits as high as $5 million to $25 million.
